California Commercial Driver’s License Rules

California follows federal guidelines provide for three categories of commercial
motor vehicles:

Class A –  any combination of vehicles with a gross combination weight
rating of 26,001 or more pounds.

Class B –  any single vehicle with a gross vehicle weight rating of 26,001 or
more pounds

Class C –  any single vehicle, or combination of vehicles, that does not meet
the definition of Class A or Class B, but is either designed to transport 16 or

Major violations – this type of violation includes anything major, such as operating a commercial vehicle while under the influence of drugs or alcohol, leaving the scene of the accident, or using the vehicle to commit a felony. The first violation results in a one‐year disqualification. The second violation under this category results in a lifetime disqualification.

Serious traffic violations – this type of violation involves a violation that is traffic related, such as excessive speeding reckless driving, improper lane changing and following a vehicle ahead too closely. A first violation will not result in disqualification. A second serious violation within 3 years will result in a 60‐day disqualification. A third serious violation within 3 years will result in a 120‐day disqualification.

The Harsh Reality of a Traffic Ticket for a Commercial Driver

CDL Traffic ViolationA traffic ticket can have serious consequences regardless of whether you are a commercial or non-commercial driver. However, for a commercial driver, a traffic ticket involves a harsher reality – both for state-imposed consequences and the impact of the commercial driver’s life. The reason for this is that commercial drivers are held to a higher standard because they spend significantly more time on the road.

Two major differences that you could face as a Commercial Driver’s License holder is:

  1. The points of each traffic violation is 1.5 times more than the points of the same violation for non-commercial drivers.
  2. Commercial drivers are not permitted to attend traffic school to eliminate these points.

These stricter consequences can mean that even one or two tickets can result in your Commercial Driver’s License being suspended or revoked. Our CDL traffic ticket defense attorneys can help you fight traffic violations and possibly get them dismissed to avoid in these harsh consequences.
